Terms of Service

You must be at least 13 years old to hold an account — or older where you live if your country sets a higher age for consenting to online services (16 in several EU and EEA countries). You sign in with Google or Apple, and you are responsible for keeping that account secure and for what happens under it. Children may appear in a family tree as people added by an adult relative — they do not hold accounts.

A tree has an owner — usually the person who created it — who can invite relatives, set what each branch can see, and remove members. Invited members can add and view content according to those settings. If you own a tree, you cannot delete your account until you hand ownership to another member, so a family never loses its tree because one person leaves.

You keep every right you already have in the photos, videos, stories and details you add. You give us only the permission we need to actually run the service: to store your content, back it up, resize and transcode it for display, and show it to the family members you have shared it with. That permission ends when the content is deleted, apart from copies already made by the family or backups already written to your own Google Drive. We do not use your content for advertising, we do not sell it, and we do not use it to train machine-learning models.

Most of what goes into a family tree is information about someone else. By adding it, you confirm you have the right to share it — including any consent needed from living relatives, and the agreement of a parent or guardian for information about a child. Do not add sensitive information about another person unless you are entitled to. If someone asks you to remove information about themselves, remove it. We may remove content ourselves if we receive a well-founded request from the person it concerns.

Don't use Treely to upload unlawful content, sexual content involving minors, content that harasses or endangers someone, or material you have no right to share. Don't attempt to reach another family's data, disrupt the service, scrape it, or work around its limits.

Any member can report content. We review reports and may remove content or suspend an account, and you can appeal a decision from within the app. We aim to act proportionately: a family disagreement is not the same as abuse.

Treely is free to start. Paid plans are bought by the person who owns the family tree — once, for the whole tree, never per member. Every member of that tree gets the plan's features at no cost to them.

Prices are in US dollars and are current at the date above. Apple and Google set the equivalent price in your local currency, and tax may be added at checkout. Storage is measured per tree and sized by the tree owner's plan.

• Plans are billed by Apple's App Store or Google Play, not by us. We never receive your card details.
• Premium and Family+ renew automatically each year until you cancel. Your account is charged within 24 hours before the current period ends, unless you cancel at least 24 hours before it does. Cancel in your App Store or Google Play subscription settings — deleting the app does not cancel a subscription.
• Forever is a one-time purchase, not a subscription. Nothing renews and nothing is charged again. "For life" means for as long as Treely operates as a service — it is not a personal guarantee and it cannot outlive the service itself. If we ever discontinue Treely, we will give at least 90 days' notice and keep the export working throughout, so you can take a full copy of your family's tree with you.
• Refunds are handled by Apple or Google under their policies. Where consumer law gives you a withdrawal or refund right, that right applies regardless of this clause.
• If a price changes, the new price applies to future purchases and renewals. We will tell you before a renewal at a new price so you can cancel first.
• If a payment fails or a plan lapses, paid features stop and your tree returns to the Free tier's limits — your family's content stays. Content that exceeded a free limit remains stored and becomes available again if you resubscribe.

If you turn on backup, Treely writes a copy of your tree and memories to your own Google Drive, using the narrow drive.file permission that lets Treely touch only the files it created. Weekly backups run on a best-effort schedule and can be interrupted by things outside our control — a revoked Google permission, a full Drive, a Google outage. Backup is a convenience, not a guarantee, and it does not replace keeping your own copies of anything irreplaceable. Files already in your Drive are yours; deleting your Treely account does not remove them.

You can delete your account at any time from Account → Delete account. What is deleted and what stays with the family is set out in our Privacy Policy — read it before you delete, because deletion is permanent.

We may suspend or end an account that breaks these terms, is used unlawfully, or puts other members at risk. Where it is reasonable to do so, we will tell you why and give you a chance to put it right first.

TREELY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We work hard to keep Treely available and correct, but we do not promise it will be uninterrupted, error-free, or that it will preserve content indefinitely. Keep your own copies of anything you could not bear to lose — the export exists for exactly that.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost content, revenue or profits. Our total liability to you, in aggregate for all claims, is limited to the greater of (a) the amount you paid us in the twelve months before the claim and (b) US$100 — the alternative matters because Forever is paid once and could otherwise leave a long-standing customer with no remedy at all.

None of this limits liability that cannot be limited by law — including death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any right you have as a consumer that cannot be waived.

If a claim is brought against us because of content you added or because you broke these terms, you agree to cover the reasonable costs of dealing with it.

We may update these terms. If a change is material, we will tell you in the app before it takes effect, and continuing to use Treely afterwards means you accept it. If you don't, you can delete your account.

Talk to us first. If something goes wrong, email hello@xplatsolutions.com describing the problem and what you would like done. Most things are solved this way, and we ask for 30 days to try before either of us starts formal proceedings.

These terms are governed by the law of the State of New York, United States, without regard to its conflict-of-laws rules, and disputes go to the state and federal courts located in New York, New York. If you are a consumer, this does not remove the protection of the mandatory law of the country you live in, or your right to bring proceedings in your local courts.
